1. Acceptance of Terms

By placing an order or using this website, you agree to these Terms of Service. If you do not agree, please do not use our services.

2. Custom Memorial Portraits

Each portrait is custom-made to order from photographs and information you provide. Because every order is personalized and kiln-fired specifically for you, custom orders are final and non-refundable once production has begun. See our Refund Policy for full details.

3. Photograph Submissions & License Grant

By uploading or otherwise submitting any photograph, image, likeness, or other content ("Customer Content") to Headstone Portraits, you represent and warrant that:

• You own the Customer Content, or have obtained all necessary rights, licenses, consents, and permissions from the copyright owner and from any person depicted (or, where the person is deceased, from the legal next of kin) to reproduce that image on a memorial product.
• Your submission of the Customer Content does not and will not infringe the intellectual property rights, privacy rights, publicity rights, or any other rights of any third party.
• You agree to indemnify and hold harmless Headstone Portraits, its owners, employees, and contractors from any claim, demand, loss, or damages (including reasonable attorneys' fees) arising out of or related to Customer Content you submit, including any claim of copyright infringement, defamation, or violation of privacy or publicity rights.

You grant Headstone Portraits a non-exclusive, worldwide, royalty-free license to use, reproduce, retouch, restore, modify, crop, resize, print, kiln-fire, and otherwise process the Customer Content solely for the purpose of producing, fulfilling, supporting, and providing customer service for your order. This license includes the right to store the Customer Content on our servers and with our subprocessors (e.g., cloud storage, payment, and email providers) for as long as reasonably necessary to fulfill the order, support reprints, resolve disputes, and comply with our legal obligations.

With your separate, opt-in consent, we may also use anonymized before/after examples of your Customer Content in marketing materials (such as our gallery or website). We will not use identifiable Customer Content for marketing without that consent. You can withdraw marketing consent at any time by emailing admin@headstoneportraits.com.

We are not responsible for verifying ownership of, or rights to, any Customer Content you submit, and we are not responsible for copyright, privacy, or publicity claims arising from customer-supplied imagery. If a credible claim of infringement is made, we may pause or cancel your order and remove the Customer Content from our systems.

4. Orders & Payment

Orders are confirmed once payment is received in full. Production typically begins within 2 business days of order confirmation. Prices are listed in USD and may change without notice prior to order placement.

5. Production & Shipping

Production time is typically 3–4 weeks. Shipping times are additional and vary by destination. Risk of loss transfers to the buyer upon delivery to the shipping carrier.

6. Wholesale Accounts

Monument company accounts are subject to approval at our discretion. Wholesale pricing is confidential and may not be shared. We reserve the right to suspend accounts for misuse.

7. Limitation of Liability

Our liability for any claim is limited to the purchase price of the product. We are not liable for indirect, incidental, or consequential damages.
